Agreement to Terms

These Terms and Conditions (“Terms”) are an agreement between you and GeoLocator Technologies Inc (“GeoLocator,” “we,” “us”). They cover your use of geolocator.app, including the free demo, the dashboard and related services (together, the “Services”).

By using the Services, you agree to these Terms. If you do not agree, do not use the Services. Our Privacy Policy explains how we handle personal data. Our Cookie Policy explains the cookies and browser storage we use.

Eligibility and Accounts

Minimum age

You must be at least 16 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the permission of a parent or guardian.

Using the Services for an organisation

If you use the Services on behalf of an organisation, you confirm that you have authority to accept these Terms for it.

Your account

If you create an account, you agree to:

• Give accurate information and keep it up to date
• Keep your sign-in details secure and not share your account
• Take responsibility for activity under your account
• Tell us promptly at contact@geolocator.app if you suspect unauthorised access

The Services

GeoLocator uses AI models to estimate where a photo was taken. To produce an estimate, we send your photo, resized and with its embedded metadata removed, to third-party AI providers, as described in the Privacy Policy.

The free demo allows a limited number of analyses per day for each IP address. We may change, add or remove features, and change these limits, at any time.

Acceptable Use

Photo geolocation can reveal where people live, work or are right now. You must use the Services lawfully and responsibly. You agree that you will NOT:

• Use the Services to stalk, harass, threaten, intimidate or dox anyone, or to find, track or monitor a person
• Use the Services to locate a private individual, or where they live, work or are, unless you have a lawful basis for doing so (for example, the person's consent, or a legal duty or right that applies to you)
• Upload images of children in order to find out where a child is, lives or goes to school
• Upload images that you do not have the right to use, or that contain other people's personal data you have no lawful basis to process
• Upload unlawful content, including sexual content involving minors, intimate images shared without consent, or content that infringes someone else's rights
• Use results to discriminate against, target or harm people, or for any purpose that breaks the law
• Get around rate limits, bot protection or other security measures, or use automated tools to access the Services without our written permission
• Try to gain unauthorised access to our systems, or interfere with or disrupt the Services
• Reverse engineer the Services, except where the law expressly allows it
• Resell or redistribute the Services or their results without our written permission

Your Content

Your rights and responsibilities

You keep all rights to the photos and other content you upload (“Your Content”). You confirm that you have the rights needed to upload it. If Your Content includes other people's personal data, such as identifiable people in a photo, you must have a lawful basis for processing it, and you are responsible for complying with the data protection laws that apply to you.

What you allow us to do

You give us a limited licence to process Your Content only to provide the Services, keep them secure and enforce these Terms. That includes sending it to our service providers (such as AI model providers) and keeping the records described in our Privacy Policy. We do not claim ownership of Your Content, and we do not use it to train AI models.

AI Results Are Estimates

Our results are estimates produced by AI models. They can be incomplete, imprecise or wrong. The explanation shown with a result is generated by AI and may be inaccurate. You acknowledge that:

• You should verify results independently before relying on them
• You must not use the Services for safety-critical purposes, such as emergency response, search and rescue, navigation, or any situation where an error could cause injury, harm or loss of life
• Results must not be the only basis for any decision or action that affects a person, including accusing, confronting or reporting someone
• The Services may be unavailable at times, for example during maintenance or provider outages

Enforcement and Legal Requests

We may investigate suspected breaches of these Terms. Where we reasonably believe you have broken them, or where we need to protect other people or the Services, we may remove content, limit your use, or suspend or close your account. Where appropriate and lawful, we will tell you why.

We may preserve and disclose information when the law or a valid legal request requires it, or when it is necessary to protect someone's life or safety. Our Privacy Policy explains what information we keep and for how long.

Intellectual Property

The Services, including our software, design and content, belong to GeoLocator or its licensors and are protected by intellectual property laws. While you follow these Terms, we give you a limited, non-exclusive, non-transferable, revocable licence to use the Services. You may use the results you obtain for any lawful purpose that is consistent with these Terms.

Fees

The Services are currently provided free of charge. If we introduce paid features, we will show you the price and the terms before you are charged anything.

Third-Party Services

The Services rely on third-party providers, which are listed in our Privacy Policy, and they link to third-party sites such as Google Maps, OpenStreetMap and Bing Maps. We are not responsible for third-party sites. Their own terms and privacy policies apply when you use them.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THIS INCLUDES IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

We do not warrant that:

• The Services will meet your requirements
• The Services will be uninterrupted, timely, secure or error-free
• Results will be accurate or reliable
• Any defects will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEOLOCATOR IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. IT IS ALSO NOT LIABLE FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE OR GOODWILL THAT RESULTS FROM:

• Your use of, or inability to use, the Services
• Unauthorised access to or use of our servers
• Any interruption or end of the Services
• Bugs, viruses or similar issues passed on through the Services
• Errors or omissions in content or results

Our total liability to you for all claims relating to the Services will not exceed the amount you paid us in the twelve (12) months before the claim.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law. This includes liability for death or personal injury caused by negligence, for fraud, and for your statutory rights as a consumer.

Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless GeoLocator and its officers, directors, employees and agents against claims, damages, losses, liabilities, costs and expenses arising from: (a) your misuse of the Services; (b) your breach of these Terms; (c) your violation of anyone else's rights, including privacy rights; or (d) Your Content.

Termination

You may stop using the Services at any time. You can delete your account in Settings in the dashboard, or ask us to delete it by emailing contact@geolocator.app. We may suspend or end your access as described in “Enforcement and Legal Requests,” or if we stop offering the Services.

When your account ends, your right to use the Services ends. We delete your account data as described in our Privacy Policy. Sections that by their nature should continue after termination will continue, including Intellectual Property, Disclaimer of Warranties, Limitation of Liability and Indemnification.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Services will be resolved by binding arbitration under the rules of the American Arbitration Association.

If you are a consumer living in the European Union, the European Economic Area, the United Kingdom or Switzerland, the arbitration clause does not apply to you. You keep the protection of the mandatory laws of your country of residence, and you may bring proceedings in the courts of that country.

Changes to Terms

We may update these Terms, and we will revise the “Last Updated” date when we do. If we make a material change, we will give notice on the site or by email before it takes effect. If you keep using the Services after a change takes effect, the updated Terms apply. If you do not agree to them, stop using the Services and, if you have an account, delete it.

Severability

If any provision of these Terms is found to be unenforceable or invalid, it will be limited or removed only as far as necessary, and the rest of these Terms will remain in effect.
